No Harmful Work

Under Law No. 2024-014, a pregnant woman may not be assigned to work that is beyond her physical capacity, hazardous, or likely to endanger her health or morals. Pregnant and breastfeeding women must not be employed at night: (1) for at least 16 weeks around childbirth, including at least 8 weeks before the expected delivery date; and (2) during any other period of pregnancy or the breastfeeding period, if a medical certificate states that the prohibition is necessary to protect the health of the mother or the child.

Protection from Dismissals

The Labour Code prohibits the dismissal of women workers during medically confirmed pregnancy and maternity leave (minimum 14 weeks), except for legitimate reasons unrelated to pregnancy. Dismissal during this period is considered unfair.

Right to Return to Same Position

No provision could be located in the law which gives a female worker the right to return to the same job/position after availing her maternity leave; however, since the labour code prohibits dismissal of women workers during pregnancy and maternity leave, there is an implied right to return to the same position.
